These Terms & Conditions apply to the use of dermadirect.com and to purchases made from DERMA DIRECT EUROPE B.V.
By accessing our website, creating an account or placing an order, you agree to these Terms & Conditions and any policies expressly incorporated into them.
In these Terms:
- “Derma Direct”, “Derma Direct Europe”, “we”, “us” and “our” mean DERMA DIRECT EUROPE B.V.
- “Customer”, “you” and “your” mean the business, professional or other person using the website or purchasing products from us.
- “Website” means dermadirect.com.

Our business activities include the purchasing, importing, storing, selling, distributing and supplying of aesthetic, cosmetic and medical-aesthetic products.
2. BUSINESS-TO-BUSINESS SALES
- Derma Direct Europe operates primarily as a business-to-business supplier.
- Products intended for professional use are supplied only to businesses and appropriately trained or qualified professionals, where such qualifications are required for the relevant product.
- By purchasing from us, you confirm that you are acting for purposes relating to your trade, business or profession and not as a consumer, unless we expressly agree otherwise.
- Where requested, customers must provide satisfactory evidence of their business status, professional qualifications, training, insurance and/or VAT registration.
- We reserve the right to refuse registration, suspend an account, request additional verification or cancel an order where we cannot satisfactorily verify a customer’s eligibility to purchase particular products.
3. GENERAL TERMS
- Agreement: By placing an order, you agree to these Terms & Conditions and any policies expressly incorporated into them.
- Website Information: We take reasonable steps to ensure information displayed on our website is accurate. Product descriptions, images, packaging, specifications, availability and other information may nevertheless change without notice, including where changes are made by a manufacturer.
- Suitability: Customers are responsible for determining whether a product is appropriate and lawful for their intended professional use and for complying with applicable laws, regulations, professional standards and manufacturer instructions in the country where the product will be used.
- Intellectual Property: Unless otherwise stated, the design, graphics, layout, text, photographs, logos and other content appearing on the website are owned by or licensed to Derma Direct Europe. Content may not be copied, reproduced, distributed or commercially exploited without our prior written permission, except where permitted by law.
- Third-Party Trademarks: Product names, manufacturer names and trademarks belonging to third parties remain the property of their respective owners.
- External Links: Links to third-party websites may be provided for convenience. We do not control and are not responsible for the content, availability or practices of third-party websites.
- Unauthorised Use:Unauthorised, fraudulent or unlawful use of the website may result in suspension or termination of access and may be reported to the appropriate authorities where necessary.
4. PRODUCTS AND PROFESSIONAL USE
- Certain products sold by Derma Direct Europe are intended exclusively for appropriately trained, qualified and insured aesthetic practitioners or medical professionals.
- Products designated for professional use must not be administered or used by an unqualified individual.
- The purchaser is responsible for ensuring that they, and any person to whom they make a product available, possess all qualifications, training, professional registrations and insurance required under the laws and professional standards applicable to them.
- Products must be used, handled and stored in accordance with the manufacturer’s instructions, Instructions for Use (IFU), labelling and applicable professional standards.
- Customers must observe all stated temperature, storage, handling and expiry requirements.
- We accept no responsibility for loss or damage resulting from:
- improper storage or handling after delivery;
- use contrary to manufacturer instructions;
- use by an insufficiently trained or unqualified person;
- unauthorised modification of a product;
- use with incompatible or unauthorised accessories; or
- use outside the product’s intended purpose.
- Availability of a product on dermadirect.com does not constitute a representation that the product may lawfully be purchased, possessed, administered or used for every purpose in every country.
Customers are responsible for determining and complying with any local legal or professional requirements applicable to them.
5. QUALIFICATION VERIFICATION
- We may require evidence of professional training or qualifications before allowing a customer to purchase certain products.
- Where applicable, proof of qualification may be required before a first order is dispatched.
- Additional verification may be requested at any time where reasonably necessary for regulatory, safety, fraud-prevention or compliance purposes.
- Providing false or misleading qualification information may result in immediate cancellation of orders and closure of the customer’s account.
6. ORDERS
- Products displayed on the website are subject to availability.
- Submission of an order does not necessarily mean that we have accepted it.
- Unless expressly stated otherwise, an order is accepted when we confirm acceptance or dispatch the goods.
- We reserve the right to refuse or cancel an order where:
- a product is unavailable;
- an obvious pricing or website error has occurred;
- payment cannot be authorised;
- we cannot verify the customer’s identity, business or qualifications;
- we reasonably suspect fraud, misuse or unlawful activity;
- the transaction may breach applicable law or regulation; or
- the product cannot lawfully or appropriately be supplied to the destination.
- Where we cancel a paid order before dispatch, amounts paid for the cancelled goods will normally be refunded using the original payment method.
- Pre-orders: Products identified as pre-order products may require approximately 7–14 working days for processing before dispatch unless another timeframe is displayed on the product page.
- Any stated timeframe is an estimate rather than a guaranteed delivery date.
7. PRICES AND VAT
- Unless expressly stated otherwise, prices displayed on dermadirect.com are exclusive of VAT.
- Applicable VAT will be determined according to the nature of the transaction, delivery destination, customer’s VAT status and applicable VAT legislation.
- Sales supplied within the Netherlands will be subject to Dutch VAT at the applicable rate unless an exemption or other applicable VAT treatment applies.
- Where goods are supplied from the Netherlands to a VAT-registered business in another EU Member State, the transaction may qualify for the 0% VAT rate as an intra-Community supply, provided all applicable legal requirements are satisfied.
- Customers requesting 0% VAT treatment must provide a valid VAT identification number and any additional information reasonably requested by us.
- We may validate VAT identification numbers and associated business information before applying 0% VAT.
- The customer is responsible for ensuring all VAT information supplied to us is complete, current and accurate.
- If a customer provides an invalid, incorrect or misleading VAT number or other information which causes VAT to be incorrectly calculated, we reserve the right to charge the VAT or other amounts that should properly have been payable, to the extent permitted by law.
- Customers receiving a qualifying intra-Community supply are responsible for accounting for VAT in their country in accordance with applicable law.
- For deliveries outside the European Union, customs duties, import VAT, clearance charges and other local taxes may become payable by the customer unless expressly stated otherwise.
8. PAYMENT
- Payment must be made using one of the payment methods offered at checkout.
- Orders may be subject to payment verification and fraud-prevention checks.
- We may delay dispatch until cleared payment has been received.
- Where legally permitted, we reserve the right to apply a clearly disclosed surcharge to certain commercial or corporate payment methods where additional processing costs apply.
Any applicable charge will be displayed before the customer completes payment.
9. PROMOTIONS AND DISCOUNT CODES
- Promotional offers and discount codes are subject to their individual terms and may be withdrawn or amended at any time before an eligible order is placed.
- We reserve the right to investigate accounts and orders where we reasonably suspect duplicate accounts, fraudulent activity or prohibited use of promotions.
- Unless expressly stated otherwise, promotional codes cannot be combined with:
- sale or reduced products;
- bundles;
- multi-buy offers;
- other promotional codes; or
- excluded brands or products identified as ineligible for promotion.
- Certain brands or products may be excluded from promotional codes where indicated on the website or within the terms of the promotion.
- Promotional, discount and referral codes must be successfully applied before payment is completed.
- Promotional codes cannot normally be applied retrospectively to completed orders, and we are not obliged to refund the difference where a customer failed to enter an eligible code before completing payment.
10. SHIPPING AND DELIVERY
Shipping services, delivery charges, delivery times, international shipping, failed deliveries, courier delays, lost or damaged parcels and any available delivery protection are governed by our separate Shipping & Delivery Policy.
Customers are responsible for providing complete and accurate delivery and contact information when placing an order.
The Shipping & Delivery Policy forms part of these Terms & Conditions where applicable to an order.
11. RETURNS, REFUNDS AND REPLACEMENTS
Returns, refunds, defective-product claims, replacements, damaged goods and order discrepancies are governed by our separate Returns & Refunds Policy.
For product-integrity, health and safety reasons, customers should contact us before returning any product.
The Returns & Refunds Policy forms part of these Terms & Conditions where applicable to an order.
12. PRODUCT RECALLS AND SAFETY
- Customers must cooperate with any legitimate product recall, field safety notice or manufacturer safety communication relating to products supplied by us.
- We may contact customers using their registered contact information where a product safety issue arises.
- Customers who redistribute products with our express authorisation must maintain sufficient records to enable affected products to be traced where required by applicable law.
13. RESALE
- Unless expressly authorised by Derma Direct Europe, products are supplied for the customer’s own professional or business use and may not be purchased for unauthorised commercial redistribution or resale.
- Customers wishing to act as wholesalers, distributors or resellers must obtain our prior written approval where required by us.
- We reserve the right to refuse or cancel orders where we reasonably believe products are being purchased for unauthorised resale.
- Serious or repeated breaches may result in account suspension or closure.
14. PRICE BEAT GUARANTEE
Where advertised, our Price Beat Guarantee applies subject to the conditions stated with the promotion.
Unless otherwise specified, the competing supplier must:
- be an established business operating within the European Union;
- comply with applicable VAT registration requirements;
- have the identical product genuinely in stock at the time of verification;
- offer the product on normal commercial terms rather than as part of a clearance, sale, special promotion or multi-buy;
- and. display or provide a price that we can independently verify.
We reserve the right to refuse a Price Beat request where these conditions are not satisfied or where there is a genuine pricing error.
15. SAMPLES
- Where samples are offered, availability is discretionary and subject to stock.
- Samples may be restricted to first purchases, particular customers or particular promotions.
- We reserve the right to decline sample requests or withdraw sample programmes.
16. THIRD-PARTY AND PRINTED MATERIALS
Where printed, promotional or marketing materials are fulfilled by a third-party provider, separate arrangements may apply.
Additional charges may apply where repeat fulfilment is required due to incorrect information supplied by the customer or other circumstances attributable to the customer.
17. LIABILITY
- Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
- Subject to clause, Derma Direct Europe shall not be liable for indirect or consequential business losses arising from the supply, delay or use of products, including:
- loss of profit;
- loss of revenue;
- loss of business;
- loss of anticipated savings;
- cancellation of appointments; or
- loss of income.
- We are not responsible for injury, damage or loss caused by improper storage, handling, administration, off-label use, use contrary to manufacturer instructions or use by persons who do not possess appropriate training or qualifications, to the extent permitted by law.
- Nothing in these Terms is intended to exclude any liability which cannot legally be excluded under Dutch or applicable EU law.
18. FORCE MAJEURE
We will not be responsible for delay or failure to perform our obligations where caused by circumstances outside our reasonable control, including severe weather, natural disasters, transport disruption, industrial action, war, civil disturbance, government action, customs disruption, epidemic or pandemic, power or telecommunications failure, cyber incidents affecting third-party infrastructure or failure of carriers or suppliers beyond our reasonable control.
We will take reasonable steps to minimise the effect of such circumstances.
19. COMPLAINTS
Complaints should be submitted to:

- description of the complaint; and
- relevant photographs or supporting information.
We aim to acknowledge complaints within 7 days and will endeavour to investigate and resolve complaints within a reasonable period.
20. CUSTOMER ACCOUNTS
- Customers are responsible for maintaining the confidentiality of their account credentials.
- Account information must be accurate and kept up to date.
- Accounts may not be transferred or shared in a manner that circumvents qualification, pricing, promotional or compliance requirements.
- We may suspend or close an account where we reasonably suspect:
- fraud;
- misuse of promotions;
- false qualification information;
- unauthorised resale;
- unlawful activity;
- abusive conduct; or
- a material breach of these Terms.
21. RETENTION OF TITLE
- To the extent permitted by applicable law, ownership of goods supplied by Derma Direct Europe remains with us until all amounts due in respect of those goods have been paid in full.
- Risk in the goods passes in accordance with the agreed delivery arrangements and applicable law.
22. CHANGES TO THESE TERMS
- We may amend these Terms & Conditions from time to time, including to reflect changes in law, regulation, our services or commercial practices.
- The version applicable to an order will generally be the version in effect when that order is placed.
- Material changes will not retrospectively alter an existing contract unless required by law or agreed between the parties.
23. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary and the remaining provisions will continue in effect.
24. NO WAIVER
Failure by Derma Direct Europe to enforce a provision of these Terms on one occasion does not constitute a waiver of our right to enforce that provision or another provision subsequently.
25. GOVERNING LAW AND JURISDICTION
- These Terms & Conditions and contracts entered into under them are governed by the laws of the Netherlands, subject to any mandatory law that applies notwithstanding this choice.
- In a business-to-business transaction, disputes arising from these Terms or the supply of products shall be submitted to the competent court in the Netherlands, subject to any mandatory jurisdictional rules.
- Before commencing legal proceedings, both parties are encouraged to attempt in good faith to resolve the dispute commercially.
